1. Boerderij De Boerinn

Article 1: Applicability

  1. These terms and conditions apply to all offers and agreements between the private limited company “De Boerinn”, hereinafter referred to as “the contractor”, and the natural person, partnership, company or legal entity that gives or has given an order tot the contractor, hereinafter referred to as “the client”.
  2. An arrangement is deemed to be all agreements between the client and the contractor with regard to activities to be organised or services to be provided by the contractor for the client.
  3. If the client is a partnership, company or legal entity, the general terms and conditions of the contractor do not apply tot the arrangement.

 

Article 2: Payment

  1. Payment shall be made by bank or giro or cash in valid Dutch currency.
  2. In case of payment by bank or giro, 50% of the agreed amount must have been paid into the account of the contractor 14 days after receipt of the down payment invoice. The remainder must be paid within two weeks after receipt of the final invoice. The contractor shall provide an invoice for this purpose. A down payment invoice will be sent for bookings over €1,000.
  3. Cash payment shall be made on the day of and immediately after the activities organized or services provided by the client unless otherwise agreed.
  4. If no payment has been made within 14 days after the end of the visit date, there shall be default and the contractor shall be entitled to charge statutory interest.
  5. Costs to be incurred by the contractor for collection of outstanding amounts shall be borne by the client. Extrajudicial collection costs are set at 15% of the claim. A payment shall first serve to reduce the collection costs, then the interest due and then the principal sum.

 

Article 3: Number of participants, guarantee turnover and changes.

  1. Boerderij De Boerinn organizes guided activities and catering for a minimum number of 10 persons. The minimum number of 10 persons does not apply to the escaperoom and unguided activities such as canoeing, supping and wooden shoe golf.
  2. Client shall, when giving the order, indicate for how many persons the activities are to be organized, taking into account paragraph 1.
  3. For private individuals and companies, the contractor applies a guarantee turnover of 80% of the turnover specified when the order was given. This guarantee turnover will be charged as a minimum.
  4. Changes to existing reservations:
  • Changes can be made up to 7 days before the visit date, whereby the order can be adjusted up to a maximum of the guarantee turnover.
  • Within 7 days before the visit date, the number of participants in activities such as poldersports, wooden shoe golf etc. can be adjusted. However, the minimum number of participants per activity and the agreed turnover guarantee always apply as a lower limit.
  • In the case of a change in the order that leads to a turnover above the agreed turnover, this additional turnover will also be charged.

 

Article 4: Cancellation

  • Cancellation is free of charge up to 60 days prior to the visit date.
  • For cancellations between 30 and 60 days prior to the visit date, 25% of the invoice amount is due.
  • For cancellation between 14 and 30 days prior to the visit date, 50% of the invoice amount is due.
  • If canceled within 14 days prior to the visit date, the total invoice amount is due.

 

Article 5: Postponement

  • A reservation can be moved up to 3 days prior to the originally agreed date. The following conditions apply:
  • There must be a valid reason such as illness or death;
  • The catering (food) already purchased by us will be charged;
  • Any room(s) booked will be charged at 50%;
  • The original down payment must be paid and will be moved to the new date;
  • A new date must be set within 2 months of the indicated shift.

 

Article 6: Obligations of the client and participant and exclusion of liability of the contractor

  1. Participants are obliged to report personal circumstances, which may hinder participation in the activities. This obligation applies in particular to all relevant medical and conditional particularities.
  2. The lack of swimming certificates (if any) is the responsibility of the client (school, parents or family).
  3. Participation is at your own risk. Not participating in certain parts will not adversely affect the course of the competition.
  4. The contractor and its employees shall never be liable for loss, embezzlement, theft or damage, direct or indirect, of or to property of participants.
  5. The arrangement will also take place in bad weather, unless other arrangements have been made in writing, or the weather is so bad that the safety of the participant(s) is endangered. The contractor shall in this case offer an alternative program which may differ in content from the original program.
  6. All visitors must comply with the contractor’s house rules.

 

Article 7: News and advertising messages

  1. Boerderij De Boerinn may send news and advertising messages once or more per month based on the contact information collected by the option or reservation.
  2. Recipients are free to unsubscribe from the newsletter/ indicate they no longer wish to receive messages.

 

 

2. Camping De Boerinn 

 

Article 1: Definitions

In these terms and conditions the following definitions apply:

  • Vacation accommodation: camping pitch (for tent, folding camper, camper or caravan), safari tent, hiker’s hut.
  • Contractor: Boerderij De Boerinn, the company that manages the campsite;
  • Recreant: the person who enters into the vacation accommodation arrangement with the entrepreneur;
  • Rules of conduct: rules concerning the use of and the stay at the campsite.

 

Article 2: Content of the arrangement

  1. The contractor shall put at the disposal of the vacation accommodation for recreational purposes, thus not for permanent residence, the vacation accommodation agreed upon for the period agreed upon.
  2. The arrangement shall be concluded on the basis of the information, folder(s) and/or other advertising material provided by the contractor to the recreant.

 

Article 3: Payment, cancellation and interim termination

  1. The total travel sum of the stay must be paid on location.
  2. In the event that the recreant cancels the arrangement before the commencement date, he shall owe an indemnity.

The indemnity shall amount to:

  • Cancellation is free of charge up to 60 days prior to the first day of the visit.
  • For cancellation between 30 and 60 days prior to the first day of the visit, 25% of the invoice amount is due.
  • For cancellation between 14 and 30 days prior to the first day of the visit, 50% of the invoice amount is due.
  • For cancellation within 14 days prior to the first day of the visit, the total invoice amount is due.

 

Article 4: Rules of conduct

  1. Recreant, his family members, lodgers, visitors and any users are obliged to comply with the rules of conduct set by the contractor, including the rules regarding any required camping and residence documents and registration obligations.
  2. Contractor is entitled to charge a deposit, if any, and withhold it if necessary.
  3. Camping de Boerinn is a family campground where hospitality, safety, sustainability and relaxation are important cornerstones. Below are the most important rules for you:
  • Amplified music is not allowed.
  • After 22:00 it is quiet on the campsite with the exception of organized activities.
  • The gate at the front of the driveway is closed from 23:00 to 6:00. Please keep this in mind as much as possible. If you are going to arrive late you can call a number and the gate will be opened. You will receive this number upon arrival at our campsite.
  • Barbecuing is only allowed on gas.
  • Lighting your own fire is allowed if you use a fire basket at a location designated by Boerderij De Boerinn.
  • Please separate waste as much as possible. Facilities are available for this.
  • Cars must be parked on the adjacent parking lot and not on the camping field itself. This is in connection with the safety of our guests.
  • Drone flying is not permitted.
  • Animals may NOT be fed. However, it is possible to walk with the zookeeper in the morning.
  • The area is suitable for children but it remains a farm where anything happens. Please bring this to the attention of your child(ren) and ensure their own safety.

 

Article 5: Liability

  1. The contractor shall not be liable for theft, accidents or damage on his premises unless they are the result of a failure attributable to him or his personnel.
  2. The recreant shall be liable towards the contractor for the damage caused by the acts or omissions of himself and/or his family members, his guests, or visitors admitted by him as far as it concerns damage that can be attributed to the recreant or them.
  3. The recreant shall be obliged to report any personal circumstances that may hinder participation in activities. This obligation applies in particular to all relevant medical and conditional particularities. Poldersport parts are at your own risk, closed (water) shoes are obligatory.
  4. Parents remain ultimately responsible for the safety of the children. Life jackets are available free of charge.
  5. The legal liability of the contractor will include at least the risk that can reasonably be covered by liability insurance with a minimum of € 500,000.00.

 

Article 6: Duration and expiration of the arrangement.

The arrangement expires automatically after the expiration of the agreed period.

 

Article 7: Interim termination by the entrepreneur and eviction in case of default

  1. In the event that the recreant, his family members, guests or visitors do not or not adequately comply with the obligations under the arrangement, the terms and conditions, the rules of conduct or the government regulations, despite prior warning, and to such an extent that by the standards of reasonableness and fairness the contractor cannot be required to continue the arrangement, the contractor shall be entitled to terminate the arrangement with immediate effect. Thereafter, the recreant must vacate the vacation accommodation and leave the premises as soon as possible. The warning may be omitted in very urgent cases.
  2. In case the recreant is of the opinion that the contractor has wrongfully terminated the arrangement, he shall immediately notify the contractor thereof.
  3. The recreant shall in principle remain obliged to pay the agreed rate.
